Trumbull County prosecutors have filed a motion asking a common pleas court judge to indicate in writing they have until at least April 16 to bring Claudia Hoerig to trial in the 2007 aggravated murder of her husband, Karl Hoerig, in their Newton Falls home.

Hoerig was brought back to the county Jan. 17 and placed in the county jail after spending nearly 11 years in her native Brazil because of Brazil’s policy of not extraditing native-born Brazilians.

Hoerig will be back in court before Judge Andrew Logan at 11 a.m. today for a second hearing, and the issue of a trial date will probably be discussed.

Defendants have a right to be tried within 90 days of their arrest if they are held in jail, as is the case with Claudia Hoerig, whose bond is $10 million.

A motion by prosecutors says the 90 days should be calculated as starting Jan. 17 because of Claudia Hoerig’s fleeing to Brazil and not being in custody until Jan. 17.
