Federal lawsuit targets Girard for I-80 speeding tickets
A former Ohio Attorney General filed a class action lawsuit in federal court that holds the city of Girard liable for speeding tickets issued to drivers after construction ended on Interstate 80.
Several drivers received tickets between Dec. and Jan. 7 for exceeding 55 miles per hour after the Ohio Department of Transportation changed the speed limit to 65.
The speed limit had been reduced during construction, but ODOT did not remove the 55 mph signs along Interstate 80 after construction ended and Girard’s speeding cameras continued to cite drivers for exceeding 55 mph.
Three plaintiffs, including one who was traveling 60 mph through the zone, request relief in the lawsuit filed by Marc Dann.
It argues that because Girard Municipal Court does not enforce traffic camera tickets, those affected did not receive due process and the tickets resulted in an unjust enrichment of the city.
The lawsuit seeks to form a class of all affected and asks a judge to order Girard to pay actual and punitive damages as well as attorney’s fees and costs to all in the class.
