Judicial release denied

A judge has overruled a defense motion for early release that was filed on behalf of a Poland man who was sentenced to 15 years in prison for a Jan. 20, 2004, homicide and an April 10, 2005, Boardman restaurant robbery.

Judge Lou A. D’Apolito declined to release Timothy A. Overman, 33, who had pleaded guilty to voluntary manslaughter in the shooting death of Jason W. Gasior, 23, in his East Midlothian Boulevard apartment, and to the aggravated robbery of the Springfield Grille.

Based on those violent crimes, Judge D’Apolito, of Mahoning County Common Pleas Court, ruled that Overman’s “continued incarceration is necessary to ensure the safety of the citizens of Mahoning County.”

Overman got one year added to his prison term in 2011 for attempted possession of a deadly weapon under detention.

Overman is in the North Central Correctional Institution in Marion.

The motion for judicial release said Overman “has shown genuine remorse,” has strong family support and has taken classes from Youngstown State and Ohio universities while incarcerated.

However, Martin P. Desmond, the assistant county prosecutor who prosecuted Overman for his 2004 and 2005 crimes, said he was opposed to his being released from prison now.

“He’s a bad guy. We don’t want him back on our streets,” Desmond said when the motion was filed.
