YURICH TRIAL UPDATE | Judge overrules defense motion to acquit Dr. Yurich of all charges
YOUNGSTOWN — Judge John M. Durkin of Mahoning County Common Pleas overruled a defense motion this afternoon for acquittal on charges against Dr. Joseph Yurich in his vehicular homicide trial.
Defense lawyer Lynn Maro argued the state did not provide sufficient evidence to prove Dr. Yurich had operated his boat while intoxicated on the night of a fatal Berlin Reservoir boat crash on May 9, 2015.
She said merely showing Dr. Yurich consumed alcohol and was involved in a crash was not sufficient.
Dawn Cantalamessa, an assistant county prosecutor, said, however, Dr. Yurich speeding at night, not stopping after realizing he hit something, deciding to drive to his home several minutes away instead of to the nearest boat dock because he was concerned his boat would sink, all indicate he was impaired when he made those decisions.
The trial will resume at 9 a.m. Monday when the defense will begin to call witnesses.
