Magistrate Anthony Sertick in municipal court Thursday upheld the designation of a dog that police said killed a 3-day-old baby Feb. 7 as vicious.

The dog was given back to its owner, James Grim, Feb. 19, after being quarantined at the Mahoning County Dog Pound after the death of Aiden Grim in his home in the 3500 block of Valerie Drive.

County Dog Warden Dianne Fry had declared the dog vicious, which means the dog’s owners must follow certain restrictions, including having $100,000 insurance on the dog.

James Grim appealed the designation. The county coroner’s office ruled the death of the baby accidental. The dog apparently tried to pick the baby up by its head as the child was sleeping in a clothes basket on the floor.

Water tests received

The Ohio Environmental Protection Agency has received another round of test results from homeowners in the village who asked to have their tap water tested.

All 12 of the most-recent samples were below the federal allowable limit for lead. The Ohio EPA ordered the village Jan. 21 to offer free water testing for any homeowner who asked.

Combined with earlier voluntary test results received, 1,042 of 1,089 samples have been below the federal allowable lead level of 15 parts per billion.

The Ohio EPA has followed up on some of the high readings and has found that the water coming into the home is safe. Running the tap for several minutes successfully eliminates any detectable lead in the water, agency officials said.

Drug arrests

Police made two drug arrests Wednesday.

Byron Henderson, 60, of Youngstown, was booked into the Mahoning County jail on a charge of possession of cocaine and driving under suspension after being pulled over about 10:05 p.m. at West Indianola Avenue and Market Street on the South Side for having no taillights. Reports said he pulled a bag of suspected crack cocaine out of his pocket just before he was searched.

Robert McFarland, 63, of Willow Drive, Boardman, was booked into the jail on a charge of possession of heroin after he was pulled over about 5 p.m. at Erie and Market streets for running a stop sign. He had a bag of suspected heroin in his pockets, reports said. Both men are expected to be arraigned today in municipal court.

Robbery charge

A federal grand jury has indicted Orlando Popa, 26, of Youngstown, on a bank-robbery charge, said acting U.S. Attorney Carole S. Rendon.

The indictment alleges that on or about Feb. 1, Popa robbed the Huntington Bank in Campbell of about $1,000. The Campbell Police Department and the FBI and its Violent Crimes Task Force investigated the case. It is being prosecuted by Youngstown-based assistant U.S. Attorney Jason M. Katz.
