Man gets six months for violating Youngstown housing code
YOUNGSTOWN
A Pointview Avenue man was sentenced today to six months in the Mahoning County jail after being found guilty of violating several sections of the city’s housing code.
The lawyer for Brandon Miller, 29, of 2028 Pointview Ave. said he will be filing an appeal with the 7th District Court of Appeals over both the conviction and sentencing of his client, who was convicted in municipal court back in June of the violations before Judge Elizabeth Kobly, who also handed down the sentence.
Abigal Beniston, who heads up code enforcement for the city, said Miller’s property had a makeshift garage, holes in the roof, the windows were dirty, and he tried to make his own driveway, among other violations.
Miller was also fined $100 for each violation and must pay court costs.
Anthony Farris, Miller’s lawyer, said his client will be booked into the Mahoning County jail but is expected to be released after his appeal has been received by the appeals court. Farris said people convicted of misdemeanors are granted a stay of their sentence by the appeals court if a trial court will not grant a stay.
