Judge says Staten cannot serve on academic distress commission

Judge Lou A. D’Apolito of Mahoning County Common Pleas Court has upheld a magistrate’s decision that Carol Staten cannot serve as an academic distress commission member.

The judge’s decision in the case filed by the Youngstown Teachers’ Association against Brenda Kimble, school board president, regarding her appointment of Staten to the academic distress commission.

The appointee should be a teacher. Staten was appointed Tuesday night as principal of Discovery of Transitions to Careers at Volney. She had been a substitute principal.

Judge D’Apolito’s decision requires Kimble to appoint a teacher by Friday.
