Man facing September sentencing arrested again

Monday morning’s arrest on weapons and resisting arrest charges should seem like deja vu for Jeffrey Brown.

Brown, 24, of East Lucius Avenue, taken into custody after a foot chase Monday morning and accused of being a felon in possession of a firearm, carrying concealed weapons and resisting arrest, faces sentencing Sept. 9 for almost the same circumstances stemming from an arrest in April – by the same officer.

He was arrested about 12:55 a.m. Monday in the 500 block of Roxbury Avenue, and reports said he had a gun on him. He is expected to be arraigned Wednesday in municipal court.

According to court records, Brown was free on bond pending a Sept. 9 sentencing in Mahoning County Common Pleas Court for a charge of being a felon in possession of a firearm after an arrest in April. Prosecutors are recommending a year in prison in that case.

Reports said officers on patrol early Monday spotted an SUV on East Lucius Avenue turn right onto Homestead Avenue after signaling to turn left. When the officers tried to pull the SUV over, it failed to stop and led police on a chase through several streets until it slowed down on Palmer Avenue. The front doors opened, and the driver and passenger both jumped out and ran.

Reports said Brown was the passenger, and as he was running from officer Kenneth Garling, he was reaching into his waist as if he had a gun. He continued running until he slipped and fell in a yard on Roxbury Avenue. Before he could get up, Garling tackled him, reports said.

On the ground, Brown continued reaching toward his waist as Garling struggled with him until another officer arrived and was able to help get Brown handcuffed. Reports said that when officers searched Brown, they found where Brown was trying to reach with his hands a loaded .40-caliber Glock semiautomatic handgun with a round in the chamber.

Officers retraced the route Brown ran and found another Glock, this one a .45-caliber semiautomatic handgun, reports said.

Brown refused to answer when police asked him questions about the gun for a form they fill out whenever a gun is recovered.

In April, reports said Brown was arrested by Garling during a traffic stop at East Lucius and Homestead avenues after a loaded .44-caliber revolver was found under the seat of the car he was driving. Reports said that when officers tried to cuff Brown, he ran away and had to be tackled before being taken into custody.

His sentencing Sept. 9 comes from his arrest in that case.

Brown also pleaded guilty in 2012 before former Judge James C. Evans in common pleas court to being a felon in possession of a firearm and was sentenced to four years in prison. In that case, he was granted judicial release, only to be taken into custody again because he violated the terms of his release. He was sent back to prison to serve the remainder of his term.
