Black Velvet whiskey found at accident scene

Police charged a Girard man with driving under the influence and violating open container law following a crash Monday evening near Logan Gate Road and Monticello Boulevard. There were two cars involved, according to police. One driver was taken to the hospital but has since been released.

A police report states that the other driver, Thomas Tubbs, 72, had two bottles of Black Velvet whiskey in his car, one of which was consumed. Tubbs had trouble standing and registered a blood alcohol content of 0.210, the report states. The legal limit in Ohio is 0.08.
