Pavlik case reset

Kelly R. Pavlik, 33, former boxing champ, appeared in court Wednesday on misdemeanor charges of assault and disorderly conduct, but his case was reset to 8:30 a.m. July 8.

Pavlik’s attorney met with Niles Prosecutor Terry Swauger in Swauger’s office, but Pavlik did not stand before Judge Thomas Townley, nor did the other parties enter the courtroom, said Nick Mientkiewicz, probation officer for Niles Municipal Court.

Pavlik, of Sugarbush Drive, Canfield, former world-champion middleweight boxer, was charged at the Pine Tree Place plaza in April after police said he was involved in a fight in the parking lot during the Foo Fighters concert that took place inside the plaza.

Charges in fight

GIRARD

Charges and citations have been filed in the case of two men who got into a fight in the middle of Church Hill Road over a traffic dispute Monday. Robert Suich, 46, of Girard, is charged with driving left of center and misdemeanor inciting to violence. Robert Scott, 47, of Girard, was issued a traffic summons for a stop-sign violation.

Drug charges

BOARDMAN

A township man faces felony charges after he reportedly tried to dispose of drugs and paraphernalia after police were called to the scene of an accident in which he was involved.

Police responded to Market Street near Shields Road for an accident about 4 p.m. Tuesday, according to a report, where they learned from another driver that Andrew Freed, 30, of Ranier Trail, struck another vehicle, got out to inspect the damage, then ran back to his own vehicle and placed items from his car into a garbage bag he disposed of in a nearby trash can.

Police found hypodermic needles, a burnt spoon and suspected heroin residue in the trash can. He is charged with misdemeanor possession of drug-abuse instruments and drug paraphernalia, felony tampering with evidence and drug possession.

Lawyers to write briefs on dismissal

WARREN

The second day of testimony in the Sergio DiPaolo trial in Warren Municipal Court ended Wednesday with the prosecution and defense agreeing to write briefs on whether the charges should be dismissed.

DiPaolo, 50, of Girard, is charged with failing to complete the demolition of three of his former Packard Electric buildings on Dana and Griswold streets by a Sept. 14, 2012, deadline and occupying the buildings without a permit.

But DiPaolo’s attorney, Michael Fortney, argued the charges should be dismissed because prosecutors have not produced an order requiring DiPaolo to demolish the buildings.

Briefs will be submitted by the parties through June 30 to Judge Thomas Gysegem.

Pleads guilty

WARREN

Heidi Powell, 34, West Park Avenue, Niles, pleaded guilty Wednesday to one felony count of theft in office for stealing $731 from her former job as Niles income-tax investigator.

She will be sentenced in about four weeks in Trumbull County Common Pleas Court after the county’s adult-probation department conducts a presentence investigation.

She plans to request a sentencing option which would allow her to have her criminal record erased if she successfully completes a treatment program.
