Pair get probation for Lake Milton burglary

Two men who were arrested in October for breaking into a Denver Drive home in Lake Milton with a boy they were baby-sitting were each sentenced to two years’ probation in Mahoning County Common Pleas Court.

Brett Wagner, 19, of Denver Drive, Lake Milton, and Tyren Jethro, 20, of Logan Arms, Girard, each received the sentences from Judge John Durkin on recommendations by attorneys in the case and presentence investigations.

The two were caught with the boy about 11:35 p.m. inside the home after neighbors called police. Reports said the boy’s mother was sleeping and had Wagner and Jethro watch him for her and they took the boy with them.

Both men were indicted and pleaded guilty to charges of burglary and child endangering. Wagner pleaded guilty to additional misdemeanor charges of drug possession and possession of dangerous drugs because he had some pills on him when he was caught.

Assistant Prosecutor Kevin Trapp said both men have minimal criminal records and the victim in the case agreed with the sentence, as well as the police who investigated.

Also, Wagner has already undergone drug treatment at Community Corrections Association and has been doing well, said his attorney, Mark Lavelle.
