The estate of a 57-year-old Ohio woman fatally mauled by two of her neighbor’s dogs is dismissing its lawsuit against the dogs’ owners as the two parties seek a resolution.
Klonda Richey was fatally mauled outside her home in February 2014. The dogs were registered to Andrew Nason and Julie Custer, who were each convicted of two misdemeanor counts of failure to control the mixed-mastiffs dogs.
Richey’s estate filed a wrongful death lawsuit in May 2014 against Nason and Custer. The suit claimed they negligently failed to restrain, control and confine their dogs and that they negligently failed to protect Richey from the “known and foreseen” risk of attack.
Attorneys for both sides say they are negotiating to see if a resolution can be reached.
