Poland property owner appeals decision preventing apartment construction

The owner of property in the township who has proposed building apartments is appealing a township decision to Mahoning County Common Pleas Court, after the township denied his request for a zone change.
An attorney for Henry Hassay Jr. and his company filed an appeal with the court Monday.
“The property owner’s appeal is made on questions of law and fact in that such decision was unreasonable and not supported by substantial, reliable, and probative evidence to support the Board’s contention that a variance will [be] ... detrimental to the general welfare or adjacent properties,” reads the document signed by Atty. Matthew Giannini.
Hassay proposed to build a multiunit residential complex on Center Road on two parcels of property just west of Tala Drive. He has requested to rezone the parcels so that he is permitted to build a multiunit dwelling rather than a single-family one.
Township trustees voted 2-1 to deny the request at a public hearing July 8.
At the July 8 hearing, attended by several residents with property near the site who opposed the proposal, Hassay said he planned to build up to seven single-floor units. At the time, he said he did not plan to build a sixplex or similar structure.
The case is assigned to Judge R. Scott Krichbaum.
