Poland property owner appeals decision preventing apartment construction


POLAND — The owner of property in the township who has proposed building apartments is appealing a township decision to Mahoning County Common Pleas Court, after the township denied his request for a zone change.

An attorney for Henry Hassay Jr. and his company filed an appeal with the court Monday.

“The property owner’s appeal is made on questions of law and fact in that such decision was unreasonable and not supported by substantial, reliable, and probative evidence to support the Board’s contention that a variance will [be] ... detrimental to the general welfare or adjacent properties,” reads the document signed by Atty. Matthew Giannini.
