Man gets seven years on child porn charges

A Beloit man was sentenced to seven years in prison Wednesday in Mahoning County Common Pleas Court on child-pornography charges.

Daniel Nutt, 25, also must register as a sex offender every 180 days for 25 years after he is released from prison.

Nutt was sentenced by Judge Lou A. D’Apolito on seven counts of improper use of a minor in nudity oriented materials. Nutt entered guilty pleas to the counts Aug. 22.

The sentence came after plea negotiations between Assistant Prosecutor Natasha Frenchko and defense attorney Sam Amendolara. Frenchko said Nutt has no prior criminal record and admitted that he had a problem when he was confronted by agents with the state Bureau of Criminal Investigation when a search warrant was served at his house in February 2013.

Frenchko said it is hoped that Nutt will get counseling in prison and will not be in trouble again.

Amendolara also asked Judge D’Apolito to abide by the recommended sentence, saying his client had a job, cared for his grandfather and also realizes that he needs help, which his arrest showed him.

“The price he is paying is great; the loss of his liberty for seven years,” Amendolara said.

Frenchko said Nutt was exchanging child-pornography images with a BCI agent who was undercover online as part of an investigation and that he had been engaging in such behavior for years before he was caught.

Nutt apologized before his sentence was handed down, and said he wanted to get counseling to deal with his problem.

“I regret everything deeply,” Nutt said.

Nutt will be given 441 days of credit toward his sentence because of the time he has spent in the county jail since was arrested Sept. 5, 2013.
