URGENT | Toney found guilty; escapes death penalty


YOUNGSTOWN — Aubrey Toney was found guilty of murder but not guilty of aggravated murder for the mistaken-identity shooting death of a man on a South Side street in 2010.

The verdict means Toney is not eligible for the death penalty.

He was also found guilty of two counts of felonious assault with firearm specifications. He faces a sentence of 26 years to life in prison.

Toney, 33, was accused of killing 74-year-old Thomas Repchic and wounding his wife Jacqueline as they were driving in a car on Southern Boulevard and East Philadelphia Avenue on Sept. 25, 2010.

Police say Toney fired at the car because it resembled a car that a man Toney has a feud with was known to drive.
