DA to seek execution in 2004 slaying retrial

HOLLIDAYSBURG, Pa. (AP) — A western Pennsylvania prosecutor says he will seek the death penalty in a retrial in the murder of a woman found dead in a lake in a park a decade ago.

Forty-one-year-old Paul Ross was convicted of first-degree murder in Blair County and sentenced to life in prison in the 2004 murder of 26-year-old Tina Miller.

But a Superior Court granted him a new trial, saying his attorney wasn’t given enough time to prepare and testimony by the defendant’s former girlfriends shouldn’t have been allowed.

The (Altoona) Mirror reports that District Attorney Richard Consiglio filed notice Tuesday of intent to seek capital punishment.

Authorities said Miller’s body was found partially submerged and bound with duct tape at Canoe Creek State Park after she was dropped off with Ross.
