Dann to argue case before state Supreme Court

COLUMBUS — Former Attorney General Marc Dann makes his first Ohio Supreme Court since its members decided to suspend his law license in 2012.

Dann, a Democrat formerly of Liberty, will be in court Wednesday. He publicized his appearance in an email sent today by a communications company on his law firm’s behalf. The press release mentions toward the top that it’s Dann’s first appearance in front of the court since the reinstatement of his law license.

Dann is representing George and Bridget Kuchta of Medina County. The couple had its home foreclosed by the Bank of America.

Dann contends the foreclosure was improper as it violates a previous Supreme Court ruling that to foreclose, a plaintiff must hold the note and mortgage of a home before it can file a foreclosure complaint. That isn’t what happened in this case, according to Dann.

The Supreme Court ruled to suspend Dann’s law license starting Nov. 20, 2012, for six months. That was as a result of Dann, who now lives and works in the Cleveland area, being found guilty in May 2010 of two misdemeanor ethics counts.
