Judge orders second sanity evaluation

A judge has ordered a second sanity evaluation for a man accused of raping and kidnapping a woman in August.

Judge R. Scott Krichbaum granted a request for a second hearing Wednesday during a hearing in Mahoning County Common Pleas Court for Matthew “Sincere” Dubose, 28, of Catalina and Norwood avenues.

Dubose is charged with five counts of rape, three counts of kidnapping and single counts of assault, robbery and gross sexual imposition.

Judge Krichbaum ordered an evaluation last year to determine if Dubose is legally sane and if he is competent to stand trial. The evaluation came back recently and said that Dubose can assist in his own defense and is competent to stand trial and that he is legally sane.

But Dubose’s attorney, Douglas King, asked for another sanity evaluation. King told Judge Krichbaum that the study just completed showed that Dubose had a mental disorder at the time of the offense but could distinguish right from wrong, but King said he wanted another opinion.

Judge Krichbaum granted the request, and prosecutors also will be seeking their own expert to evaluate Dubose. Judge Krichbaum said the law allows for up to three evaluations, and because of the number and nature of the charges Dubose is facing, he granted King’s request for another evaluation.

Dubose is accused of breaking into a St. Louis Avenue home on the South Side on Aug, 27 and raping a woman inside.

According to Mahoning County court records, Dubose was ordered to register as a sexually oriented offender in 2007 after being convicted of sexual contact with a minor.
