Man asks to withdraw guilty plea

A man who pleaded guilty to felonious assault in 2012 and was sentenced to six years in prison asked a Mahoning County Common Pleas Court judge for permission to withdraw his plea and have a jury trial.

Jason Peck, 38, filed the motion Tuesday before Judge Maureen Sweeney, who sentenced him in November 2012 after he pleaded guilty to charges of felonious assault and a misdemeanor count of domestic violence in an attack on a woman in May 2012.

He appealed his sentence to the 7th District Court of Appeals, which vacated his sentence because it ruled the trial court did not consider whether the two charges he pleaded guilty to arose out of the same conduct, which could affect his sentence.
