Ben W. Lupo, owner of D&L Energy and Hardrock Excavating, will appear March 15 in U.S. District Court here for arraignment on an indictment charging him with violating the federal Clean Water Act.
Lupo will appear before Magistrate Judge George J. Limbert. Afterward, Michael P. Guesman, a Lupo employee, and Hardrock Excavating will be arraigned on the same charge.
The indictments came after state regulators learned Lupo had instructed Guesman to dump a mixture of oil, brine water and drilling mud into a storm drain at Hardrock’s headquarters at 2761 Salt Springs Road on Jan. 31.
Hardrock is appealing an Ohio Department of Natural Resources’ ruling last week that permanently revoked the company’s brine-hauling permits.
Teen killed in crash
LISBON
A teenager was killed in a one-vehicle accident Sunday night on Lisbon Road, according to the Ohio State Highway Patrol’s Lisbon Post.
Brittany Marie Gulu, 17, of Salem, was traveling on Lisbon Road near St. Jacobs Logtown Road about 9:45 p.m. when the 2000 Volkswagen Beetle she was driving slid off the roadway and struck a mailbox and a tree before overturning, according to the patrol.
Gulu was ejected from the vehicle, troopers state. She was taken to Salem Community Hospital, where she was pronounced dead. The crash remains under investigation.
