Doctor pleads guilty to attempted theft

Dr. David P. Esarco, a Boardman chiropractic physician, pleaded guilty to attempted theft and attempted insurance fraud and paid $47,988 in restitution to six insurance companies when he entered his plea Friday before Judge James C. Evans of Mahoning County Common Pleas Court.

In the plea agreement, the prosecution agreed to reduce a theft charge to attempted theft and an insurance fraud charge to attempted insurance fraud and to dismiss a tampering-with-records charge and recommend probation. The offenses occurred in connection with Dr. Esarco’s chiropractic practice between 2004 and 2011.

Dr. Esarco, 53, who resides on Shady Glen Trail in Poland, remains free on his own recognizance pending his 1:30 p.m. March 20 sentencing.

“The state was interested in restitution being made and that the victims be made whole, and, at this time, that has been accomplished, so the state felt that community control was the appropriate sentence,” said Kerry Limbian, an assistant county prosecutor.

Dr. Esarco has an active Ohio chiropractic license expiring March 31, 2014, and no formal disciplinary action exists against his license, according to state professional-licensing records. He first was licensed as a chiropractor in 1987.
