Boardman chiropractor pleads guilty to attempted theft and attempted insurance fraud

YOUNGSTOWN

Dr. David P. Esarco, a Boardman chiropractor, pleaded guilty to attempted theft and attempted insurance fraud and paid $47,988 in restitution when he entered his plea this morning before Judge James C. Evans of Mahoning County Common Pleas Court.

In the plea agreement, the prosecution agreed to reduce a theft charge to attempted theft and an insurance fraud charge to attempted insurance fraud and to dismiss a tampering with records charge and recommend probation. The offenses occurred in connection with Dr. Esarco’s chiropractic practice between 2004 and 2011, according to the indictment.

Dr. Esarco, 53, who resides in Poland, remains free on his own recognizance pending his 1:30 p.m. March 20 sentencing.

Kerry Limbian, an assistant county prosecutor, said she made the plea deal and recommended probation because the state’s primary interest was in restitution to the six insurance companies.
