Man to prison for assault, but not dad’s death
SLIGO, Pa. (AP) — A 55-year-old western Pennsylvania man could spend nearly 12 years in prison for assaulting his 79-year-old father, but not for the man’s resulting death.
The (Oil City) Derrick reports James Shimmons, of Sligo, was sentenced Wednesday by a Clarion County judge to five years, 10 months to 11 years, eight months in prison.
Shimmons had claimed he acted in self-defense when he beat Cloyd Alvin Shimmons at the older man’s home on July 15, 2012. Cloyd Simmons died two days later of a related brain injury.
But a jury earlier this month acquitted James Shimmons of various murder and manslaughter charges he faced, finding him guilty only of aggravated and simple assault charges.
Shimmons will receive credit for more than a year he’s already served in the county jail.
