D&L Energy bankruptcy hearing under way in Youngstown
YOUNGSTOWN — The first hearing in U.S. Bankruptcy Court concerning D&L Energy’s bankruptcy stalled this morning in a dispute over payments to a company that supervised the cleanup of a Jan. 31 oilfield waste spill into a Mahoning River tributary.
Nicholas Paparodis, D&L’s president, testified that Enviroscience out of Stow, Ohio, which supervised the cleanup, has refused to provide a report to the U.S. Environmental Protection Agency, which is due Monday, unless it receives payment for its services.
D&L owes Enviroscience $123,000, according to a list of creditors in the Chapter 11 Bankruptcy filing.
If the report is not timely filed, the U.S. EPA could fine D&L $37,500 a day, Paparodis testified.
An Enviroscience executive was traveling to Youngstown for the afternoon court session.
