Ohio defendant not ready to give up marijuana


CINCINNATI (AP) — A judge offered a drug defendant the chance to stay out of prison if he’d give up marijuana, but he asked if could smoke some more first.

Hamilton County Common Pleas Judge Melba Marsh says she was astonished by the request from 19-year-old Damaine Mitchell. The Cincinnati Enquirer reports today she told Mitchell that instead of prison for selling marijuana, he could agree to a drug treatment program, requiring him to stop smoking pot.

Mitchell replied that would be a challenge since he’s been “smoking weed” since he was 10 years old and he likes it.

Finally, he proposed trying to quit if she’d let him have one more joint first.

Instead, the judge sent him back to jail for now.
