A federal judge has put a Girard man on three years’ probation with six months of home detention after he earlier had pleaded guilty as charged to 13 counts of failing to report and pay to the IRS $92,433 in employment taxes withheld from employees of his company between 2006 and 2009.

Patrick M. Rubinic, 48, who has no prior criminal record, drew the sentence Thursday from U.S. District Court Judge Patricia Gaughan, who also ordered him to file past-due tax returns and make past-due tax payments.

Rubinic pleaded guilty to willfully failing to report and turn over to the IRS federal income and Social Security taxes withheld from employees of Knight Line Embroidery of Girard and causing that money to be used for other purposes.

Rubinic also failed to report and pay to the IRS the employer’s share of the Social Security taxes, the U.S. attorney said.

Rubinic’s lawyer, Michael B. Bowler of Akron, urged leniency in sentencing, saying Rubinic is the main financial supporter of his family, and that he and one of his four minor children suffer from serious medical conditions.
