Business owner’s widow sues driver of car that hit him

The widow of a towing company owner, who was struck and killed by a car as he cleared glass from a previous wreck on U.S. Route 224 in Boardman, has sued the driver of the car that hit her husband.

Delores Macejko filed the lawsuit Friday on behalf of the estate of her late husband, Paul P. Macejko, 56, of Lowellville, who owned Macejko Service & Towing in Struthers and was struck and killed at the crash scene at 1:12 a.m. Sept. 3, 2011.

Listed as defendants are the driver, Brandon P. Porter, 28, of Indianola Road, Boardman, who the suit says negligently operated his car, and the Progressive Insurance office in Canfield, which insured Macejko.

The lawsuit says Delores Macejko has requested arbitration of the uninsured or underinsured motorist claim she filed with Progressive.

The complaint seeks more than $25,000 in compensatory damages from Porter and a judgment against Progressive for the full amount of the policy limits.

The suit, which demands a jury trial, was filed in Mahoning County Common Pleas Court by Atty. Mark S. Gervelis and assigned to Judge James C. Evans.

A claims adjuster, who answered the phone at Progressive’s Canfield office, said the company would have no comment. Porter could not be reached to comment.
