New testimony denied in Ohio coin dealer's appeal

TOLEDO, Ohio (AP) — The former Ohio coin dealer and GOP fundraiser at the center of a state investment scandal can’t gather new testimony in his quest for a new trial.

The Blade newspaper reports a federal judge here who’s considering Tom Noe’s appeal said in a ruling this week that she must look only at the existing evidence.

A defense attorney wanted to question a prosecutor in Noe’s 2006 trial.

Noe was convicted of stealing from a $50 million rare-coin fund he oversaw for the Ohio Bureau of Workers’ Compensation. He’s now serving an 18-year prison term.

In the appeal, defense attorney Rick Kerger says the trial court made errors, including not moving the case out of Toledo. He has said local media subjected Noe to an “unrelenting barrage” of coverage.
