Sex offender pleads guilty
CLEVELAND
A registered sex offender, who was arrested on a parole violation at the Austintown public library, has pleaded guilty to a federal charge of possessing child pornography.
Jimmie D. Davis, 35, of Austintown, who entered his plea Wednesday before U.S. District Judge James S. Gwin, remains jailed without bond pending his sentencing at 12:30 p.m. May 11 .
Davis pleaded guilty to knowingly possessing a cellular-phone memory card, a portable hard drive, three CDs and a desktop computer, all containing child pornography transmitted in interstate commerce. He faces 10 to 20 years in federal prison.
Davis was put on five years’ parole April 28, 2010, after he was released from state prison where he had been sentenced to serve nine years on a 2001 rape and gross-sexual- imposition conviction in Marion County, Ohio.
Under terms of his parole, he was to have no contact with his daughter; he was not to possess any pornography or possess or use any electronic device with storage capacity; and he was not to frequent libraries or other places where children congregate.
Upon visiting Davis’ residence Dec. 27, 2010, his parole officer learned Davis had just been dropped off at the Austintown library.
When his parole officer saw him in the library, Davis tried to log off a library computer he was using, the parole officer reported.
Davis admitted to his parole officer he had made Internet contact with his daughter Dec. 21, 2010; the cellphone was seized upon his arrest; the portable hard drive was taken from him at the Mahoning County jail; and the CDs and computer containing child pornography were seized from his bedroom, according to an FBI affidavit.
The devices were examined by the Ohio Bureau of Criminal Identification and Investigation and found to contain images of pre-pubescent girls engaged in sexual conduct or shown in sexually explicit poses, the affidavit said.
