DA: Execution sought in parking garage slaying

LANCASTER, Pa. (AP) — Prosecutors say they will seek the death penalty against a man accused of having killed another man in a parking garage two months ago.

The (Lancaster) Intelligencer Journal/Lancaster New Era says Lancaster County prosecutors filed notice Friday of intent to seek capital punishment if 22-year-old Jose Lebron-Garcia of Lancaster is convicted of first-degree murder.

Assistant District Attorney Mark Fetterman alleged that the defendant “created a grave risk of death” to others by opening fire during a dispute in the Lancaster parking garage, killing 28-year-old Pablo Fuentes. Police said the two had been involved in a dispute inside nearby Club Paradise.

Lebron-Garcia waived a preliminary hearing earlier this month.
