Trial delayed in dying man's blinks identifying Ohio gunman

CINCINNATI (AP) — The trial of an Ohio man charged with murder based on a dying man’s eye blinks identifying him as the gunman has been delayed.

The trial of Ricardo Woods in the 2010 fatal shooting in Cincinnati of David Chandler had been scheduled to begin Monday in Hamilton County Common Pleas Court.

But Judge Beth Myers delayed it after Woods’ defense attorney said a key expert witness would not be able to testify in August because of scheduling conflicts.

A hearing in the case still is scheduled for Monday, when the parties could agree on a new trial date.

Authorities say a videotaped interview of a paralyzed Chandler shows that he identified Woods as his shooter by blinking three times for “yes.”

Woods’ attorney says the blinks were unreliable.
