Woman in jaywalking death wants charges dropped

ATLANTA (AP) — A Georgia woman who faces criminal charges in the jaywalking death of her 4-year-old son is asking an appeals court to dismiss all charges against her.

Raquel Nelson’s attorney Steve Sadow asked the Georgia Court of Appeals today to toss out all charges against her stemming from her son A.J.’s death in April 2010. He died after bolting from his mother while crossing a busy suburban Atlanta street.

She was convicted in July of vehicular homicide, reckless conduct and jaywalking and sentenced to a year of probation, but she took a judge’s offer of a new trial instead. The vehicular homicide charge was later dismissed, but Nelson’s attorney wants all charges dropped.

Prosecutors, meanwhile, declined to make arguments at today’s hearing and wouldn’t comment afterward.
