Supreme Court upholds firing

The Ohio Supreme Court in Columbus has left intact a 7th District Court of Appeals decision upholding the firing of Richard Malagisi as Mahoning County facilities management director.

The top court did so by refusing to hear the case and dismissing Malagisi’s appeal “as not involving any substantial constitutional question.”

Saying they weren’t satisfied with his job performance, the county commissioners fired Malagisi on Sept. 15, 2005.

The State Personnel Board of Review dismissed his appeal of his termination, saying Malagisi missed his 30-day deadline when he appealed on Oct. 21, 2005.

Magistrate Dennis J. Sarisky and Judge Maureen A. Sweeney, both of Mahoning County Common Pleas Court, affirmed the personnel board’s decision.
