Roger Clemens in court to argue against second trial
WASHINGTON (AP) — A hearing is under way in federal court to consider whether former pitching star Roger Clemens should face a second trial on charges he lied about using performance-enhancing drugs.
Clemens sat at the defense table wearing a blue shirt and tie and gray suit as his attorneys were arguing all charges against him should be dismissed.
They say another trial would violate his constitutional protection against facing the same charges twice. They accuse prosecutors of purposely violating court orders to provoke a mistrial because their case was going badly the first time.
Prosecutors say they forgot to scrub their exhibits to comply with an order issued on the eve of the trial's beginning and mistakenly showed jurors inadmissible evidence. They are asking for another chance to convict Clemens.
