COLUMBUS (AP) — A federal judge has upheld Ohio’s new rules governing how inmates are put to death and has refused to delay the execution of a condemned killer who shot his three sons.

The ruling today by U.S. District Court Judge Gregory Frost rejected defense attorneys’ arguments that the state hadn’t done enough to change its policies.

Judge Frost says the state has tightened the rules to prevent the type of random variations, such as not having enough executioners on a given day, that he criticized in a July ruling.

The decision was a setback for Reginald Brooks, scheduled to die Nov. 15 for shooting his 11-, 15- and 17-year-old sons in East Cleveland two days after his wife had served him with divorce papers.
