Appellate court upholds firing of former Mahoning County supervisor


YOUNGSTOWN — A three-judge panel of the 7th District Court of Appeals has unanimously upheld the dismissal of Richard Malagisi’s appeal of his termination as Mahoning County facilities management director.

Saying they weren’t satisfied with his job performance, the county commissioners fired Malagisi on Sept. 15, 2005. Malagisi appealed his termination to the State Personnel Board of Review on Oct. 21, 2005, but the personnel board dismissed the appeal, saying Malagisi missed his 30-day deadline to appeal.

Magistrate Dennis J. Sarisky and Judge Maureen A. Sweeney of Mahoning County Common Pleas Court affirmed the personnel board’s dismissal. On Tuesday, the appeals court upheld the common pleas court ruling.
