No charges for Ohio deputies in diabetic's arrest
CINCINNATI (AP) — A prosecutor in Cincinnati says he won’t seek criminal charges against sheriff’s deputies accused of using excessive force against a man who was having a diabetic emergency.
An outside consultant hired by Hamilton County Prosecutor Joe Deters to review the case recommended against charges. Attorneys for John Harmon say the decision announced today won’t affect his federal civil rights violations lawsuit against the deputies and sheriff’s office.
The marketing executive was on his way home from work in 2009 when deputies spotted him weaving and suspected he was a drunken driver.
This lawsuit alleges deputies smashed his window, dragged him from his vehicle, and pummeled him while using a stun gun repeatedly. Initial charges of resisting arrest and failing to comply with a police officer were later dropped.
