Man gets 90-day jail term for sex with underage girl
YOUNGSTOWN
A city man convicted of sexual activity with an underage girl will spend 90 days in Mahoning County jail and the next five years on probation.
Treven Johnson, 23, who listed addresses on West Glenaven Avenue and Arch Street, had been indicted on 20 counts of rape and two counts of gross sexual imposition. The rape charges were in connection with a minor who is mentally impaired.
Johnson entered into a plea agreement with prosecutors whereby he pleaded guilty to two counts of attempted rape and two counts of gross sexual imposition. The remaining rape charges were dropped under the plea agreement.
Johnson was facing a maximum of 19 years in prison on the four felony charges to which he pleaded. Prosecutors recommended a probation sentence with sex-offender treatment and employment counseling.
Carla Baldwin Fields, an assistant county prosecutor, said Wednesday the prosecutor’s office entered the plea agreement to avoid going to trial with little physical evidence and placing a mentally impaired juvenile on the stand.
“This was a messy situation,” she said. “After speaking with the victim, her family and social workers, we decided that this was the best solution. We had no actual physical evidence.”
Judge James C. Evans adopted the prosecutor’s recommendation and sentenced Johnson to five years’ probation, but the judge ordered that Johnson spend the first 90 days of his sentence in the county jail. He will get credit for the 24 days he has already served.
The charges against Johnson stem from the multiple rapes of a Youngstown girl who was 13 at the time. The indictment says the crimes took place for several months between 2008 and 2009.
According to police reports, the girl’s mother learned of the sexual assaults on her daughter in May 2009 and took the girl to the police department to file a report.
Police reports say the girl told officers she had been staying at the South Side home of a relative on West Glenaven Avenue at various times when Johnson and an unnamed male juvenile would have sex with her.
Police questioned the juvenile, who denied having sex with the girl but admitted touching her.
Reports say the mother took the girl to a women’s center for testing after learning of the sexual activity. The mother, at that time, learned the girl was 20 weeks pregnant.
