Man seeks release from jail

Charles Etto, who was sentenced to two months in jail Monday, is asking Judge R. Scott Krichbaum to let him out.
Etto, 40, of Austintown, was sentenced to 60 days in Mahoning County jail followed by five years’ probation on a felony charge of complicity to commit aggravated assault and a probation violation from previous drug-trafficking and child-endangering charges. The felony charge stemmed from an incident in September 2010, when Etto handed his son a baseball bat during a fight outside the family’s residence.
Atty. James Vitullo filed a motion for furlough Friday, asking Judge Krichbaum, of Mahoning County Common Pleas Court, to let his client out of jail Thursday for a mandatory medical examination with the Ohio Bureau of Workers’ Compensation. Etto is on workers’ comp after an industrial accident, and those benefits are his family’s only income, the motion stated.
“His time in jail suspends his benefits, and there is the potential that missing this appointment could further jeopardize the benefits,” according to the motion.
A representative from Judge Krichbaum’s court said as of Friday afternoon, the judge hadn’t made a decision on the motion.
