METRO DIGEST || Sentence stayed on former Pellin Ambulance owner

Sentence stayed

YOUNGSTOWN

The 7th District Court of Appeals has stayed the sentence imposed on Richard M. Pellin Jr., 38, of Diamond, a former owner of the now- defunct ambulance company that bore his family’s name, pending his appeal.

Pellin was sentenced Nov. 16 to five years’ probation, with the first 60 days under electronically monitored house arrest, fined $5,000, and ordered to make restitution after being convicted of complicity to theft. Judge James C. Evans of Mahoning County Common Pleas Court imposed the sentence.

In granting the stay Friday, the appeals court noted that, had the house-arrest run its full course, it would have expired before completion of the appeal. The appeals court granted the stay conditioned upon Pellin’s $15,000 bond being continued and upon his obeying all state laws.

Restraining order

YOUNGSTOWN

A magistrate has issued a temporary restraining order forbidding the previous officers and directors of the Old Holy Trinity Serbian Orthodox Church, 420 N. Raccoon Road, from interfering with the church’s new elected directors and officers or with its pastor, the Rev. Dragan Goronjic.

The order was issued Thursday by Magistrate Daniel P. Dascenzo of Mahoning County Common Pleas Court at the request of the church, which elected new officers and directors Dec. 4.

The former officers and directors must return church property, including bank accounts, keys, passwords, safe combinations and other church books and records; and PNC Bank and Home Savings and Loan must give the new officers and directors access to the church’s accounts, the order says.

The magistrate will conduct a preliminary injunction hearing on the matter at 1:30 p.m. Jan. 5.
