Rape charge is dismissed

campbell

A rape charge against a Boardman man was dismissed Friday in Campbell Municipal Court.

Dashawn L. Hayden, 35, had been charged with a rape at the Tandy Apartments on Monette Street on July 29.

A woman reported that five or six men had forced her to take heroin there before the alleged rape.

Campbell Law Director Mark Kolmacic said the charge was dismissed because the victim indicated she could not be present at a preliminary hearing that was scheduled Friday.

Kolmacic said that after charges are filed, a preliminary hearing must be held within 10 days.

Kolmacic said the charge could be refiled, or it could be presented directly to a Mahoning County grand jury.
