Man dies in crash

YOUNGSTOWN

A crash that killed a 40-year-old North Side man on Marshall Street at 2 a.m. Friday is under investigation.

Arnyl Benson, of Crandall Avenue, was alone and speeding westbound when the pickup truck he was driving left the street, ran through a fence, and plowed underneath a parked delivery truck at the Pepsi distribution center, said Sgt. Patricia Garcar, crash investigator.

Benson wasn’t wearing a seat belt and clearly exceeded the 25 mph speed limit, Garcar said, but his exact speed still is unknown. There were no witnesses, and nobody else was injured, Garcar said.

An autopsy was being performed Friday morning by Dr. Joseph Ohr, forensic pathologist and deputy Mahoning County coroner.

Judge removes self from case

A judge who was set to hear a case involving a woman accused of running over a man out for his morning walk has stepped aside.

Judge Diane Vettori recused herself Thursday from the case of Whitney Yaeger, 20, of Springfield Township.

Yaeger is charged with misdemeanor vehicular homicide in the June 17 death of David Muslovski, 55, of Unity Road in Springfield Township.

She told state police she did not see him because she was texting on her cellphone, a police report indicated.

Judge Vettori, who hears cases in Mahoning County Court in Sebring, is the second judge to recuse him or herself from the case. Struthers Judge James Lanzo also recused himself, saying he has known the Muslovski family for a long time, and he is representing Muslovski’s wife in a civil action regarding the death.

The Struthers clerk of courts did not know the reason for the recusal. Judge Vettori could not be reached to comment Friday.

The man pointed a gun at them and demanded their purses, which they gave him, the report said.

The man fled with the purses. One contained $20 and a digital camera. The other contained $180, a cash-advance card and a cellphone.
