DiPaolo agrees to comply with laws

Sergio DiPaolo of Girard, charged criminally twice in recent months for demolition projects his company has carried out in Trumbull County, has agreed to comply with Ohio’s air-pollution laws or face fines ranging from $50 to $200 per day.
The agreement came Thursday in a civil suit filed in Mahoning County Common Pleas Court in September by the Ohio attorney general’s office.
The suit alleged that DiPaolo and his companies failed to obtain permits and properly dispose of material containing asbestos at two demolition sites.
One instance was Boardman Supply Co. on Southern Boulevard in Boardman in 2005, by a DiPaolo company called Source One Contractors. The other was a demolition carried out by DiPaolo companies Source One Contractors and/or Ohio One Contractors at an industrial facility called Direct International on First Street in Newton Falls in 2007.
DiPaolo signed a consent agreement Thursday that was written by Mahoning County Magistrate Dominic DeLaurentis in which DiPaolo agreed to “take all measures necessary to comply with Ohio Air Pollution Control laws.”
Specifically, DiPaolo must provide the Mahoning Trumbull Air Pollution Control Agency in Youngstown with written notification before the start of demolition or renovation activities.
He also must provide the MTAPCA with an asbestos survey before removing regulated asbestos- containing materials, the order says.
Failing to meet these requirements will cost DiPaolo $50 per day for the first 30 days, $100 per day for the second 30 days and $200 per day for every additional day, the agreement says.
DiPaolo purchased the former Delphi Packard Electric buildings on Dana and Griswold streets in Warren in January for $80,000, but city officials filed a stop-work order against DiPaolo after finding workers from his company inside the buildings removing salvage without a permit Jan. 26.
DiPaolo faces criminal charges in Warren Municipal Court related to the Delphi buildings and alleged open dumping at an industrial facility in Champion.
