Man pleads guilty in crash

A Newton Falls man whose drunken and high-speed driving led to a Nov. 28, 2009, crash on North Leavitt Road in Warren Township and the death of two passengers has pleaded guilty to all charges and has been sentenced to nine years in prison.

David Eubank, 24, of Arhaven Drive, pleaded guilty Monday in Trumbull County Common Pleas Court to two counts of aggravated vehicular homicide and two counts of aggravated vehicular assault.

Judge Peter Kontos sentenced Eubank to four years in prison for each of the homicides and one additional year for the assaults.

The Ohio State Highway Patrol said Eubank’s car was traveling “at a very high rate of speed” just before it hit two trees, split in half, and the pieces tumbled down the embankment along the Mahoning River near Canoe City MetroPark.

None of the five people in the car was wearing a seat belt, and all were ejected from the vehicle.

Eubank’s blood-alcohol level after the 2:20 a.m. accident was 0.203, which is more than two times the legal limit of 0.08.

Passengers Benjamin Bosley, 25, of Leavittsburg, and Rory J. Drnek, 25, of Mansfield, were pronounced dead at the scene. Eubank and passengers Michael Lester, 24, of Leavittsburg, and Amber Hann, 23, of Newton Falls, were taken to area hospitals and survived.
