Prosecutor objects to length of prison term in child-porn case

A Brookfield man who pleaded guilty to receiving and distributing child pornography over the Internet has been sentenced to 16 years and eight months in federal prison, followed by 15 years of parole.

During a two-hour hearing Wednesday, that punishment was imposed on Brian J. Radachy, 51, of Warren-Sharon Road, by U.S. District Judge Solomon Oliver Jr.

Michael A. Sullivan, the assistant U.S. attorney prosecuting the case, objected to the sentence, saying the prison term should have been between 30 and 40 years in accordance with federal sentencing guidelines.

Radachy, who previously was designated as a registered sex offender, pleaded guilty in June to receiving and sharing illegal images of sex acts involving minors.

The federal investigation of Radachy began in February, when an FBI agent accessed a shared set of Internet files in California containing hundreds of child-pornography images and determined that they belonged to Radachy.

The images contained photos of 7- and 8-year-old boys engaged in sex acts with other boys and adult men.

Using a search warrant in April, the FBI confiscated from Radachy’s bedroom about 600 compact discs containing images of nude boys and men engaged in sex acts.

While his residence was being searched, the FBI said Radachy admitted using a file-sharing program to trade child pornography over two to three years.
