A man who was sentenced to four years in prison in February 2009 after pleading guilty to aggravated vehicular homicide has been sued by representatives of the estate of his deceased passenger.
The civil lawsuit was filed by the estate of Amir Fareed of Youngstown against Humes A. Gregory Jr., 50, of East Lucius Avenue, who drew the prison time from Judge James C. Evans of Mahoning County Common Pleas Court; the car owner, Shannon Petrosky, also of East Lucius Avenue; and Viking Insurance Co. of Richmond, Va.
Neither Gregory nor Petrosky could be reached to comment.
The suit says Gregory negligently caused Fareed’s death at age 43 in a May 15, 2008, collision with a cement truck on Glenwood Avenue near Midlothian Boulevard.
Gregory was driving a car south on Glenwood and thought he could beat the northbound cement truck, and the crash occurred when he turned in front of it, police said.
City Prosecutor Jay Macejko said Gregory was intoxicated at the time of the crash.
Gregory was granted judicial release from prison last December.
The suit, which demands a jury trial and seeks damages in excess of $25,000, was filed earlier this week in common pleas court and assigned to Judge Evans.
