Family sues over Ohio man's hospital death


CINCINNATI (AP) — The family of a 45-year-old psychiatric patient has sued University of Cincinnati police and the hospital where he died.

The federal suit filed Monday alleges excessive force and negligence in the January death of Kelly Brinson. He suffered from mental disorders including delusions and had gone voluntarily to University Hospital.

He later became agitated and tried to hit a security guard. Authorities say police used a stun gun on Brinson during a scuffle, and he went into cardiac arrest and died three days later.

University police have called the case tragic but say they tried to calm Brinson as he resisted them. A coroner’s report says he was in a high state of agitation.

The hospital declines comment on the lawsuit, which seeks unspecified damages.
