City gets TRO to padlock house as public nuisance
YOUNGSTOWN
City Prosecutor Jay Macejko has sought and received a temporary restraining order to padlock and board up a house at 904 E. Florida Ave. as a public nuisance.
Judge Lou A. D’Apolito of Mahoning County Common Pleas Court issued the order Wednesday and set a hearing on Macejko’s request for a permanent injunction to close the house for 9 a.m. July 27.
Macejko sought the TRO based on complaints about recent illegal-drug activity and gunfire on the premises. An undercover police informant made crack-cocaine purchases at the house on two occasions earlier this month, and police executed a search warrant there on July 8, Macejko added.
Macejko filed the civil-nuisance action against Todd Mittleman of Orlando, Fla., who owns the house; the D’Amico Co. of Youngstown, which manages it; and Charlotte Perry and Darrell Croom, who were listed as the home’s occupants.
Tom D’Amico, owner of the D’Amico Co., could not be reached to comment.
