Innocent pleas entered in double-fatal crash


WARREN — A Newton Falls man has pleaded innocent to two counts of aggravated vehicular homicide and two of aggravated vehicular assault in the Nov. 28 accident on North Leavitt Road that killed two passengers and injured two others.

David Eubank, 24, was driving a 1997 Ford Mustang at a “very high rate of speed” when his vehicle left the roadway, hit two trees and split into two pieces that tumbled down an embankment, the Ohio State Highway Patrol said.

The accident occurred at 2:20 a.m. near Canoe City in Warren Township.

The patrol said Eubank had a blood-alcohol level of .203, which is 2 1/2 times the legal limit of 0.08. None of the five people in the car was wearing a seat belt, and all were ejected from the vehicle.

Eubank appeared in Warren Municipal Court on the charges and was released on a personal recognizance bond of $25,000, meaning that he only had to sign for the bond, not pay any money. He returns to court at 2:15 p.m. Feb. 11.

Benjamin Bosley, 25, of Leavittsburg, and Rory J. Drnek, 25, of Mansfield were pronounced dead at the scene. Eubank, Michael Lester, 24, of Leavittsburg, and Amber Hann, 23, of Newton Falls were all taken to area hospitals.

Forum Health Trumbull Memorial Hospital had no information on Hann, but St. Elizabeth Health Center said Lester was released, but an official said she didn’t know where he had gone.

If convicted of all four charges, Eubank faces up to 26 years in prison.
